TERMS & CONDITIONS OF ENTRY

1. APPLICABILITY

Information on how to enter and prizes form part of these conditions. Entries must comply with these conditions to be valid.

2. COMPETITION PERIOD

The Competition will commence on 2/9/2023 (Commencement Date) at 9:00AM AEST and end on 31/9/2023 (End Date) at 11:59 PM AEST] (Competition Period).

3, ELIGIBLE ENTRANTS

(a) Entry is open to all people residing in Australia (excluding the ACT) who:

(i) are over 18 years of age;

(ii) have registered as a bronze, silver, gold or platinum member (Member) of the SICLIDS Club; and

(iii) agree to SICLIDS’s terms and conditions and privacy policy ww.siclidsclub.com

(b) Each person who complies with clause 3(a) above will be an ‘Eligible Entrant’ for the purposes of these terms and conditions.

(c) The maximum number of entries per Eligible Entrant for the duration of the Competition is:

(i) 1 for bronze members;

(ii) 5 for silver members;

(iii) 15 for gold members; and

(iv) 25 for platinum members.

4. COSTS

Entry into the Competition is free for Eligible Entrants.

5. DISCLAIMER

Eligible Entrants acknowledge and agree that the Competition is not a service where anything of monetary value is included as part of a method of entry and prize. In no way does the Competition involve online gambling and gaming.

The Competition is advertised by SICLIDS on various platforms, including Facebook. By participating in the Competition, Eligible Entrants acknowledge that the Competition is not sponsored, endorsed, administered by or associated with Meta in any way. By participating in the Competition, Eligible Entrants fully release and hold Meta harmless from any liability.

SICLIDS does not require Eligible Entrants to share, repost, tag others or in any way publicise the Competition. Any promotion of the Competition by the Eligible Entrants is done solely by the Eligible Entrants, without the involvement of SICLIDS.

6. SUBMITTING AN ENTRY

(a) Eligible Entrants will be taken as submitting an entry into the Competition when they register as a Member.

(b) To have a valid entry in the Competition, Eligible Entrants must be a Member prior to the Commencement Date of the Competition.

(c) Once the Eligible Entrant has submitted an entry in accordance with clause 6(b), the entry will be taken to have been officially accepted by SICLIDS as a valid entry. Once an entry has been accepted, no changes to or withdrawal of the entry will be permitted.

7. DRAW

(a) The Competition will comprise of the running of a draw where, via completely random means one of the Eligible Entrants will be selected as the winner (Winner). This draw will take place on 35/115 Cochrane’s rd Moorabbin 3189.

(b) Eligible Entrants that were not chosen as the Winner in a previous draw will be able to enter the Competition for subsequent draws.

(c) A Winner of the Competition may participate in any subsequent draws during the Competition Period.

8. PRIZES

(a) The prize that will be given to the Winner for each entry is as follows- Major Prize- Cusotm Painted Helmet and the bonus prizes will be a replica helmet .

(b) If applicable, the value of any Prize is in Australian Dollars.

(c) All taxes and local government fees (excluding GST) that may be payable as a consequence of receiving the Prize are the sole responsibility of the winners.

(d) SICLIDS is not liable for any loss or damage (even if caused by negligence) as a result of any Winner accepting and/or using the Prize, except for any liability which cannot be excluded by law.

(e) Eligible Entrants acknowledge that SICLIDS makes no promise or guarantee regarding the suitability of the Prize. If the winners have an issue or complaint with any organisation associated with the Prize, SICLIDS is not responsible for resolving the issue (though they may choose to do so).

9. ANNOUNCEMENT OF WINNERS

(a) SICLIDS will publish the Winner of the Prize on the SICLIDS and SICLIDS Club website within 48 hours of the End Date.

(b) An employee of SICLIDS will notify the Winner within 24 hours via a message on their Social Media Account, email and/or SMS (each a Notification).

(c) Once notified, the Winner must provide SICLIDS with the following details:

(i) full name;

(ii) contact number; and

(iii) postal address.

(d) SICLIDS will post the Prize via registered mail to the Winner’s Postal Address within 14-28 business days of receiving confirmation of the details in clause 9(c).

10. PRIZE SUBSTITUTION

(a) In the event that any part of the Prize become unavailable for reasons beyond SICLIDS’s control, SICLIDS may, at its absolute discretion, substitute the Prize (or the relevant part of the Prize) with a prize of equal or greater value.

(b) In the event that the Winner requests a different prize, SICLIDS may, at its absolute discretion, substitute the Prize (or a relevant part of the Prize) with a prize of equal or greater value.

(c) The Prize is not redeemable for cash or credit under any circumstances.

11. UNCLAIMED PRIZES

(a) SICLIDS will use its best endeavours to contact the Winner of the Prize however SICLIDS will not be liable for the Winner’s failure to receive a Notification of winning.

(b) Winners will have 3 months to respond to the Notification with a message outlining the details in clause 9(c) otherwise they will forfeit the Prize and SICLIDS will conduct a new draw.

(c) If the Winner fails to comply with the instructions in a written notification on claiming the Prize, the Winner’s entry will be disqualified, and they will not be entitled to the Prize.

12. USE OF ELIGIBLE ENTRANTS’ PERSONAL INFORMATION

(a) SICLIDS will collect the Eligible Entrant’s personal information, including names, addresses, contact numbers and photos of the Winner with the Prize (where the context permits) for the purpose of conducting the Competition. SICLIDS may disclose the personal information it collects to third parties, including local regulatory authorities and SICLIDS’s agents or third-party service providers for the purposes of conducting the Competition or for promotional and marketing purposes, including on social media (Purpose).

(b) By entering this Competition, the Eligible Entrants consent to the use of their personal information for the Purpose, and that SICLIDS may contact them for future marketing purposes without payment.

(c) Eligible Entrants may access, change and/or update their personal information by emailing SICLIDS at [email protected]. A copy of SICLIDS’s privacy policy is available here: https://siclidsclub.com/privacy-policy. The privacy policy contains information about how individuals may access or correct personal information or make a privacy related complaint.

13. GENERAL CONDITIONS

(a) SICLIDS accepts no responsibility for late, lost or misdirected entries or other communications.

(b) Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify SICLIDS. An Eligible Entrant should direct any request to access or modify any information provided as part of the redemption of a prize to SICLIDS.

(c) SICLIDS may at their absolute discretion request verification of any personal information of Eligible Entrants provided for the purposes of the Competition and arranging a prize.

(d) SICLIDS reserves the right to disqualify any individual who breaches these terms and conditions, or who is involved in any way in interfering or tampering with the fair and proper conduct of this Competition. Failure by SICLIDS to enforce any of its rights does not constitute a waiver of those rights.

(e) By entering this Competition, Eligible Entrants acknowledge and agree that these terms and conditions, the Competition and the consequences of receiving a prize may be subject to the terms and conditions of third-party service providers such as social media platforms, video platforms, payment providers and transfer companies (Third Party Terms). SICLIDS will not be liable for any damage or loss suffered by the Eligible Entrants in connection with such Third Party Terms.

(f) Participants in the Competition may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by SICLIDS. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the maximum extent that it is permitted to do so by law, SICLIDS (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, incidental, special or consequential, arising in any way out of the Competition, including, without limitation:

(i) any theft, unauthorised access or third party interference;

(ii) any entry that is late, lost, altered, damaged or misdirected (whether or not after the receipt by SICLIDS) due to any reason beyond the reasonable control of SICLIDS;

(iii) any variation in market value of the Prize to that stated in these terms and conditions;

(iv) any tax implications; and/or

(v) the Prize or any use of the Prize.

(g) Eligible Entrants and winners of the Competition agree at all times to indemnify and hold harmless SICLIDS and its officers, employees and agents (“those indemnified”) from and against any loss (including reasonable legal costs) or liability incurred or suffered by any of those indemnified where such loss or liability was caused by the Eligible Entrants and/or winners or their officers’, employees’ or agents’:

(i) breach of any term of these terms and conditions; or

(g) Eligible Entrants and winners of the Competition agree at all times to indemnify and hold harmless SICLIDS and its officers, employees and agents (“those indemnified”) from and against any loss (including reasonable legal costs) or liability incurred or suffered by any of those indemnified where such loss or liability was caused by the Eligible Entrants and/or winners or their officers’, employees’ or agents’:

(ii) negligent, fraudulent or criminal act or omission.

(h) SICLIDS will not liable for performance delays nor for non-performance due to causes beyond their reasonable control. If the Competition is not capable of running as planned, SICLIDS reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, or amend these terms and conditions, unless to do so would be prohibited by law.

(i) These terms and conditions are governed by the laws applying in Australia.
